LICENSE AGREEMENT (last edited: 11 Nov, 2007)

Notice to users

CAREFULLY READ THE FOLLOWING LICENSE AGREEMENT. USE OF THE SOFTWARE PROVIDED WITH THIS AGREEMENT (THE "SOFTWARE") CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT INSTALL AND/OR USE THIS SOFTWARE. USER'S USE OF THIS SOFTWARE IS CONDITIONED UPON COMPLIANCE BY USER WITH THE TERMS OF THIS AGREEMENT.

License grant

Lovelysoft grants you the following rights:

Applications Software. You may install and use one copy of the SOFTWARE on a single computer. "You" means the company, entity or individual whose funds are used to pay the license fee. "Use" means storing, loading, installing, executing or displaying the SOFTWARE. The primary user of the computer on which the SOFTWARE is installed may make a second copy for his or her exclusive use on a portable computer.

Storage/Network Use. You may also store or install a copy of the SOFTWARE on a storage device, such as a network server, used only to install or run the SOFTWARE on your other computers over an internal network; however, you must acquire and dedicate a license for each separate computer on which the SOFTWARE is installed or run from the storage device. A license for the SOFTWARE may not be shared or used concurrently on different computers.

Other rights and limitations

Evaluation. When you first obtain a copy of the SOFTWARE, you are granted an evaluation period of not more than seven (7) days, after which time you must pay for the SOFTWARE according to the terms and prices discussed in the SOFTWARE's documentation, or you must remove the SOFTWARE from your computer.

Software Transfer. This license is not transferable to any other software product or other company, entity, or individual.

Termination. Without prejudice to any other rights, Lovelysoft may terminate this license if you fail to comply with the terms and conditions of this license. In such event, you must destroy all copies of the SOFTWARE and all of its component parts.

Ownership

The SOFTWARE is owned and copyrighted by Lovelysoft. Your license confers no title or ownership in the SOFTWARE and should not be construed as a sale of any right in the SOFTWARE.

Unauthorized use

You may not use, copy, rent, lease, sell, modify, decompile, disassemble, otherwise reverse engineer, or transfer the SOFTWARE except as provided in this agreement. Any such unauthorized use shall result in immediate and automatic termination of this license.

Distribution

You may distribute copies of the evaluation version (i.e. Trial Version) of this product. You may assume you have our authority to distribute the evaluation, unless we explicitly tell you otherwise. It must, however remain in its original, unmodified state, and all its constituent files must be included. No one may charge for the evaluation product itself, although a reasonable fee for the media used and copying costs is allowable.
You may not distribute copies of the licensed version of this product. A licensed copy is defined as one which has been unlocked with a registered name and serial number.

Disclaimer of warranty

THIS SOFTWARE AND THE ACCOMPANYING FILES ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. Because of the various hardware and software environments into which "THE SOFTWARE" may be put, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS OFFERED.

YOU USE THE SOFTWARE AT YOUR OWN RISK. LOVELYSOFT WILL NOT BE LIABLE FOR DATA LOSS, DAMAGES, LOSS OF PROFITS OR ANY OTHER KIND OF LOSS WHILE USING OR MISUSING THIS SOFTWARE.
